These General Terms and Conditions of Sale (GTC) govern the sale of mattresses and bedding accessories by Nokto to its consumer customers. Any order implies full and unreserved acceptance of these GTC.

Article 1 — Purpose

These GTC define the conditions under which Nokto sells its mattresses, bed bases and bedding accessories to any natural person acting outside their professional activity.

Article 2 — Products

The essential characteristics of the products (composition, dimensions, technologies, firmness, warranty) are described on the product sheets and in the commercial documentation.

Given the artisanal nature of the manufacturing, slight variations in shade, material or finish may exist between the image and the product delivered without constituting a defect of conformity.

Article 3 — Order

The order is firm and final once it has been accepted by Nokto by returned signed quote, purchase order or written confirmation.

Article 4 — Price

Prices are expressed in euros, all taxes included, excluding delivery charges.

The prices applicable are those displayed on the day of the order.

Article 5 — Payment

Unless otherwise agreed, a deposit of 30 % of the total amount including tax is required at the time of the order; the balance is due no later than upon delivery.

Any late payment automatically triggers penalties equal to three times the legal interest rate, plus a flat-rate recovery fee of 40 euros (Article D. 441-5 of the French Commercial Code).

Article 6 — Delivery

Average production lead time: 4 to 8 weeks.

Delivery is carried out in metropolitan France and, by quotation, to certain countries within the European Union.

Any reserves must be made in writing to the carrier and forwarded to Nokto within 3 working days (Article L. 133-3 of the French Commercial Code).

Article 7 — Transfer of ownership and risks

Products remain the property of Nokto until full payment of the price.

Risk transfers upon effective delivery (Article L. 216-4 of the French Consumer Code).

Article 8 — Right of withdrawal

The Customer has a period of 14 days from receipt of the product to exercise the right of withdrawal, without justification (Article L. 221-18 of the French Consumer Code).

Products must be returned new, in their original packaging. Direct return costs are borne by the Customer. Refund is made within a maximum of 14 days.

In accordance with Article L. 221-28, the right of withdrawal does not apply to products made to the Customer's specifications (custom mattresses, special dimensions).

Article 9 — Legal warranties

Nokto is bound by the warranty of conformity (Articles L. 217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

The Customer has a period of two years from the delivery of the goods to act under the warranty of conformity.

Independently of legal warranties, Nokto grants a commercial warranty whose duration and terms are specified in the product documentation.

Article 10 — After-sales service

Any after-sales request should be addressed to contact@nokto-beds.com or by post to the Nokto head office.

Article 11 — Liability

Nokto cannot be held liable for any failure resulting from a case of force majeure, or from the Customer's actions (misuse, lack of maintenance), or from the actions of a third party unrelated to the service.

Nokto's liability, when engaged, is strictly limited to the amount of the order concerned.

Article 12 — Personal data

The data collected is processed in accordance with the privacy policy available on the website.

Article 13 — Mediation and disputes

In the event of a dispute, the Customer is invited to first contact Nokto customer service.

In accordance with Articles L. 611-1 et seq. of the French Consumer Code, the Customer may resort free of charge to a consumer mediator.

Failing amicable resolution, any dispute will fall within the jurisdiction of the competent French courts.

Article 14 — Applicable law

These GTC are governed by French law. They are drafted in French; in case of translation, only the French version shall prevail.
